Terms of Service

These terms govern your use of Atheena, a service operated by Ritwik Kanodia and Madhav Sainanee ("we", "us"). By signing in or using Atheena you agree to them. If you do not agree, please don't use Atheena. Our Privacy Policy explains how we handle your data.

1. The service

Atheena finds the things you need to do in the accounts you connect (such as Gmail, Fathom and Pocket), lists them as todos, and gives you an AI agent that can work on them. Atheena is in early access: features may change, stop working for a time, or be discontinued. We'll give reasonable notice before discontinuing Atheena entirely, so you can take your data with you.

2. Your account

• You must be at least 18, and able to form a binding contract, to use Atheena.
• You sign in with a Google account, and you are responsible for keeping that account secure.
• You may connect only accounts, numbers and API keys that you are authorised to use, and you are responsible for following the terms of those services.

3. The AI agent acts on your instructions

This is the most important part of these terms.

• The agent runs only when you start it, by typing a request, choosing a suggested action, or replying on WhatsApp. Once it starts, it can use the access you granted to send and draft email, create and edit documents, spreadsheets and calendar events, and use a web browser to fill in and submit forms.
• Its actions are real, and many are permanent. A sent email or a submitted form cannot be unsent. Stopping a run halts it, but does not reverse what it already did. Atheena keeps a record of the actions taken in each conversation so you can see what happened.
• AI makes mistakes. Todos, suggested actions and the agent's work can be wrong, incomplete or badly judged. The agent is instructed to ask you rather than guess facts about you, and to stop before an irreversible step it would have to guess at, but it does not always get this right. Review its work whenever the outcome matters.
• Other people's words can reach the agent. Emails and web pages are written by other people, and some are written to trick an AI into doing something it shouldn't. The agent reads that content while it works, and it could be misled. Don't give the agent access, or tasks, that you would not be comfortable with if this happened.
• You are responsible for actions taken at your direction, including messages sent and forms submitted in your name, and for making sure they are lawful and follow the rules of the sites and services involved.

4. Acceptable use

You agree not to use Atheena, or direct its agent, to:

• break the law, or infringe anyone's rights, including privacy and intellectual property;
• send spam, or harass, threaten, impersonate or deceive anyone;
• get around security controls, CAPTCHAs or access limits on any site or service;
• interfere with, overload, probe or reverse-engineer Atheena, or access another user's data;
• make purchases, trades or financial transfers that you have not reviewed and approved yourself.

We may suspend or end access for anyone who breaks these rules.

5. Your content

You keep all rights to your content: your email, meeting notes, messages, todos and anything the agent produces for you. You give us permission to store, process and transmit it only as needed to run Atheena for you, as described in the Privacy Policy. We don't claim ownership of it, and we don't use it to train AI models.

6. Third-party services

Atheena works with services run by others, including Google, OpenAI, Meta (WhatsApp), Resend, Fathom and Pocket, and with any website the agent visits for you. Those services have their own terms and policies, and we are not responsible for their availability or for what they do.

7. Fees

Atheena is currently free. If we introduce charges, we'll tell you in advance, and nothing will be charged without your agreement.

8. Ending your use

You can stop using Atheena at any time. Disconnect your accounts in Settings, revoke access from your Google Account permissions page, and email hello@atheena.app to have your data deleted. We may suspend or end your access if you break these terms, if we have to by law, or if we discontinue Atheena.

9. Disclaimer

Atheena is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Atheena will be uninterrupted or error-free, that it will find every todo, or that the agent's work will be correct.

10. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or opportunities, arising from your use of Atheena, including from actions the agent took at your direction. Our total liability for any claim relating to Atheena is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50. Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You agree to cover our reasonable losses and costs from claims by others that arise from your breach of these terms, or from content or actions you directed Atheena to send or take.

12. Changes to these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll let you know by email or in Atheena before they take effect. If you keep using Atheena after that, you accept the updated terms.

13. Governing law

These terms are governed by the laws of India, and disputes will be handled by the courts of India, unless the law where you live gives you the right to bring a claim there.
